DUBUQUE, Iowa (AP) — Lawyers for a teenager accused of killing his custodial grandparents are seeking a mistrial after a witness testified that child pornography was found on a computer in the family home.
The Dubuque Telegraph Herald reports (http://bit.ly/1c2juNe) Judge Michael Shubatt immediately told jurors to disregard the statement by an investigator who specializes in computer forensics, but a defense attorney says it could influence the jury. Attorney Jill Eimermann sought a mistrial.
The statement came up during the second day of testimony in the murder trial of 18-year-old Isaiah Sweet. He's accused of killing his grandparents, 55-year-old Richard Sweet and 62-year-old Janet Sweet.
A prosecutor asked the judge to overrule the mistrial motion because the statement was only a small part of the trial.
Shubatt says he'll rule on the request Monday.
