ROCHESTER, MN-- A man who claims to be the leader of a "Vampyre Nation" is pinning his hopes on a petition in federal court.
Jonathon Sharkey refused an attempt to settle his case in Olmsted County Court on Friday.
Sharkey's public defender and county prosecutors had a deal worked out.
It reportedly would have had Sharkey plead to a gross misdemeanor and enter an Alfred Plea.
It involves no admission of guilt, but is the same as a guilty plea.
Sharkey is facing a felony charge of harassment and 2 coercion charges.
Prosecutors claim he harassed a 15 year old girl and her family in the summer of 2007.
Sharkey, 45, has said he would not have wasted his time, but the girl told him he she was a member of an Elite Vampyre Hunter Society.
The New Jersey man claims to be a blood feeding vampyre/hecate witch.
He takes seriously any potential threats to his "kind" and wanted the girl to give him the names of the people who might do harm to his people.
One of the reported sticking points in trying to work out a pre-trial settlement was a demand by Sharkey that he receive an apology from the Olmsted County Attorney's Office for unfair prosecution.
Sharkey also wanted the county to agree prosecute the teenaged girl for the statements he claims she made to him.
On Friday a county judge refused to listen to listen to Sharkey's explanation in open court for not going ahead with the plea deal.
If Sharkey had agreed to the deal offered by the county, he probably would have been able to leave Olmsted County after the 8 months he has spent behind bars in both Tennessee and in Minnesota.
But there is an arrest warrant waiting for him as soon as Olmsted County is finished.
The Marion County Sheriff's Office in Indianapolis, Indiana wants him for a charge of intimidation which was filed in February.
Under the many claims in his federal habeous corpus filing, sharkey contends that Minnesota has violated his right of equal protection and his prosecution is biased and prejudiced.
No hearing has been scheduled in federal court in St. Paul.
Sharkey is scheduled to face trial in Olmsted County on June third.
