CHARLES CITY, IA- Lawyers for a teenager accused of murder are working to get evidence tossed out of his case.

15 year old Edgar Concepcion of Charles City is charged with the murder of Krystel Banes.

We're sitting in on a pre-trial hearing in the case of Edgar Concepcion Junior.

He's charged with the first degree murder and sexual abuse of his three year old cousin. Concepcion's attorney is trying to surpress evidence from the police investigation.

Specifically a taped confession from the night Banes died. Concepcion Junior sat quietly for hours this afternoon as his sisters, cousins, and parents testified.

The questions revolved around police interrogation of family members last July.

The defense is trying to prove that the police did not give the family an option about whether or not to be interviewed. The prosecution did ask the family members if at any time a police officer or human service official told them they had to stay and respond to questions. All of the family members agree they never heard authorities ask that question.
